Before you decide

Many emigrant parents want to spare their children the problems of a stuck inheritance. A gift may be the best solution, but it is not the only one, and as a rule it cannot be undone. That is why we explain all the alternatives and their consequences before any step is taken:

  • Gift with reserved usufruct the parents keep using the house or receiving the rent.
  • Fairness between the children how the gift counts in the future inheritance and what to protect.
  • Taxes what is paid in Portugal and what may have to be declared in the country where the children live.
  • Keeping the assets and preparing the inheritance when this is the better option.

What we do

  1. We look at the properties and the family's situation.
  2. We regularise whatever is needed before the gift: registrations, areas and the identification of the land.
  3. We prepare the powers of attorney for the children who live abroad.
  4. We prepare and authenticate the deed of gift.
  5. We handle the Tax Office report and the registration in the children's names.

The parents can sign during one of their visits to Portugal, and the children are represented.
